A) General Information

Ordering process

Once you have found the desired product, you can add it to your shopping cart by clicking the [Add to Cart] button. You can view the contents of your shopping cart at any time by clicking the [Your Cart] button. You can remove products from your cart at any time by clicking the [Quantity] button. If you wish to purchase the products in your shopping cart, click the [Checkout] button. Please then enter your information. Required fields are marked with an asterisk (*). Registration is not required. After entering your information and selecting your payment method, you will be taken to the order page by clicking the [Review & Submit] button, where you can review your entries again. By clicking the [Place Order] button, you complete the order process. You can cancel the process at any time by closing the browser window. Further information, such as how to correct your entries, is available on the individual pages.

B) General Terms and Conditions/Cancellation Policy

1. Scope

For all deliveries and services from Storchenwiege ® These General Terms and Conditions apply to all transactions between GmbH & Co. KG (hereinafter referred to as Storchenwiege ® ) and consumers (§ 13 BGB).

2. Contracting parties

3. Offer and conclusion of contract

Our offers regarding price, quantity, delivery times, and delivery options are always non-binding. The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. Errors and omissions excepted. Before you initiate and finalize the order process by clicking the "Place order" button, you can delete and correct your entries. By clicking the "Place order" button, you submit a binding order for the goods listed on the order page. We will then send you an email confirming receipt of your order. This order confirmation does not constitute acceptance of your offer, but merely informs you that we have received your order. The purchase agreement is concluded when we accept your order by sending an order confirmation via email. We will confirm the shipment of the ordered goods to you with a separate email (shipping confirmation).

4. Right of withdrawal

Consumers have a 14-day right of withdrawal in accordance with Sections 312 b), c) and g) in conjunction with Section 355 of the German Civil Code (BGB).

4.1 Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

In the case of a contract for several goods ordered by the consumer in a single order and delivered separately, the withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last item.

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but this is not obligatory.

You can obtain the cancellation form at www.storchenwiege.de/widerrufsformular

To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.

4.2. Consequences of the revocation

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than 14 days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.

We may refuse reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return the goods to us without undue delay and in any event no later than 14 days from the day on which you notify us of your withdrawal from this contract.

to return or hand over the goods. The deadline is met if you send the goods before the 14-day period expires.

In the event of a valid cancellation, we will bear the usual costs of returning the goods (postal service) for shipments within Germany. If we have shipped the ordered goods to a location outside of Germany in accordance with the contract, the customer bears the costs of the return shipment.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.

4.3. Notes:

Please note that there is no statutory right of withdrawal for the following contracts:

Contracts for the supply of goods that are not prefabricated and for whose production an individual statement or specification by the consumer is decisive, which are clearly tailored to the personal needs of the consumer. (e.g. Storchenwiege ®) Baby carrier sling in a length that differs from the standard lengths)

4.4. Further information:

a) To make returns easier for you (within Germany), you can contact our customer service by email at info@storchenwiege.de or by phone at +49 3437 9359980 and request a Freeway ticket, which you can use for free return shipping (this applies exclusively to returns within Germany; for returns outside of Germany, the buyer bears the return shipping costs). Using a Freeway ticket is voluntary, and you can alternatively send the goods via postal service. However, we kindly ask you to refrain from sending goods back collect when exercising your right of withdrawal. Please note that if you choose an unnecessarily expensive shipping method, you may be required to pay the difference compared to returning the goods via postal service.

b) We hope our foreign customers will understand that we cannot reimburse the costs of returns from abroad, regardless of the value of the goods.

c) We would also like to point out that if you return the goods without the original packaging and instructions for use, you may be liable for compensation for the diminished value. Therefore, please keep the original packaging and instructions for use until you have decided to exercise your right of withdrawal. However, this is not a prerequisite for the effective exercise of your right of withdrawal.

d) We would also like to point out that we only accept returns of goods that are unused, unwashed and in their original packaging with instructions for use.


5. Retention of title

All deliveries are subject to retention of title. Ownership of the goods only passes to you upon full payment of our invoice.

6. Complaints/Liability

We offer a 2-year warranty on our products when used as intended. Should you have any reason to make a claim, please inform us immediately upon receipt of the goods. This also applies to damage incurred during transport. Your statutory warranty rights (according to the German Civil Code, BGB) remain unaffected. In the case of a justified claim, the statutory provisions apply. Unless otherwise stated below, further claims – regardless of their legal basis – are excluded. We are therefore not liable for damages that did not occur to the delivered goods themselves; in particular, we are not liable for lost profits or other financial losses of the customer. To the extent that contractual liability is excluded or limited, this also applies to the personal liability of our employees, representatives, and agents. The foregoing limitation of liability does not apply if the cause of the damage is due to intent or gross negligence, or if personal injury (injury to life, body, or health) is involved. If a fundamental contractual obligation is breached negligently, the liability for property damage is limited to the typically foreseeable damage. If the remedy for a defect is provided by way of replacement delivery, the customer is obligated to return the originally delivered goods to us at our expense within 30 days. The return of the defective goods must be carried out in accordance with statutory regulations. We reserve the right to claim damages under the legally stipulated conditions.

Using a Freeway ticket is voluntary, and alternatively, you can send the item by post. However, we kindly ask you to refrain from sending goods back freight collect when exercising your warranty rights. Please note that if you choose an unnecessarily expensive shipping method, you may be liable for the difference in cost compared to returning the item by post.

7. Prohibition of further processing and modification

All products of the company Storchenwiege® , in particular the Storchenwiege® fabric, may not be commercially processed or altered. Any further processing or alteration of Storchenwiege® Any warranty claims are void for products sold privately.

8. Copyright

All products from the company Storchenwiege ® Including the user manuals, they are subject to copyright.

9. Online Dispute Resolution

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

10. Other

We accept no liability for printing errors. Differences in form and color between product images and the actual goods may occur due to technical reasons. All technical specifications and descriptions are subject to change without notice. German law applies exclusively. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. If our customer does not have a general place of jurisdiction in Germany or is a merchant, our place of business shall be the exclusive place of jurisdiction for all disputes arising from this contract.
